Rules of origin are a pivotal part of free trade agreements (FTAs). Criticized as overly complex and heterogeneous, they are often accused of creating a “spaghetti bowl effect”, with traders … struggling to identify the criteria and obligations applicable to each of their trade flows.

Lietuvoje nepreferencinės prekių kilmės sertifikatus išduoda Prekybos, pramonės ir amatų rūmai, remdamiesi paraiškose nurodytais duomenimis. Kadangi paraiškoje pateikiami duomenys ne visuomet … būna tikslūs, o šiam dokumentui negalioja principas de minimis (smulkmenos, mažareikšmiai dalykai nekeičia esmės), aptarsime nepreferencinę prekių kilmę patvirtinančio sertifikato reikšmę tarptautinėje prekyboje.

„Muitų teisė praktikams“ Nr. 4 aptarėme, kad Incoterms® 2010 sąlygos apibrėžia pirkėjo ir pardavėjo susitarimą dėl pagrindinių su prekių pristatymu susijusių išlaidų apmokėjimo ir prekių nuosavybės … bei su tuo susijusios rizikos perėjimo momentą. Tačiau deklaruojant prekių vertę dažnai pamirštama, kad šios sąlygos buvo kurtos prekybos palengvinimo, o ne muitinės tikslais, todėl jos tampa neatitikimų šaltiniu.

Visas iš trečiųjų šalių į Europos Sąjungos teritoriją įvežamas prekes privaloma deklaruoti muitinei. Prekių deklaravimo muitinei pagrindas yra prekybinė sąskaita, kuria remiantis deklaruojama … prekės muitinė vertė. Nemažai klausimų dėl teisingo sąskaitų išrašymo kyla susidūrus su retesniais atvejais, pavyzdžiui, kai prekės tiekiamos neatlygintinai ir jų vertė nustatoma tik muitinės tikslams.

The new version of the WCO Harmonized System (HS) Nomenclature entered into force on 1 January 2012. It includes 220 sets of amendments: 98 relating to the agricultural sector; 27 to the chemical … sector; 9 to the paper sector; 14 to the textile sector; 5 to the base metal sector; 30 to the machinery sector; and an additional 37 that apply to a variety of other sectors.

The WCO secretariat is currently rounding off its work related to the implementation of the 2012 version of the Harmonized System (HS) Nomenclature, which mainly comprises updating HS publications … and tools, such as the Explanatory Notes, the Alphabetical Index and the Compendium of Classifi cation Opinions.

1 January 2012 marks an important date on the international Customs and trade calendar: from then onwards the HS Nomenclature 2012 edition will be in effect.

The World Customs Organization has issued a list of recommended amendments to the Harmonized System (HS) nomenclature that will enter into force on 1 January 2012. Affected goods include certain … animals and animal products, foods and agricultural products (fruits, vegetables, grains, nuts, spices, etc.), chemical substances, wood products, textile products, machinery, furniture and video game consoles. These recommendations were adopted by the WCO Council in June 2009 and WCO Members have six months to register any objections.
