On the one hand, the broker is a customs expert, possesses relevant experience and, ultimately, … receives a commission for his/her work. This article considers the most common misconceptions of importers in cooperation with customs brokers, which cause losses for both sides.

Generally, traders … find someone, such as a customs agent, to complete the formalities for them. In this case, the customs agent would act as either a direct or an indirect representative. This article explains the difference between these two types of representations and what the responsibilities and liabilities are for both the trader and the customs agent.

It often happens that customs declarations are incorrectly filled out. Such errors are not necessarily intentional and are often nothing more than carelessness. The question in such cases is … whether it is possible to amend the customs declaration retrospectively and how. Whereas it is accepted it is possible to go back and correct particulars about the goods and their value, the customs administration has generally not allowed the customs declarant to be amended in this way. Susiduriame su problema, kad forminant muitinės deklaracijas centralizuotos sistemos principu (pavyzdžiui, deklaracija forminama Klaipėdoje, … o prekių pateikimo vieta yra Vilnius) prekių tikrinimo atveju (raudonas kanalas) kartais reikalaujama, kad prekių tikrinime privalomai dalyvautų muitinės tarpininko įmonės darbuotojas. Kadangi vykti į kitą miestą būtų didelės laiko ir kaštų sąnaudos, ar galima įgalioti tikrinime atstovauti kitą asmenį (pavyzdžiui, vairuotoją)?

Straipsnyje aptariame pastarųjų metų (2019 – 2020 m.) Lietuvos teismų praktiką administracinių nusižengimų atsakomybės bylose, kuriose išaiškintos deklaranto (fizinio asmens, pildančio muitinei … teikiamus dokumentus (deklaracijas, pranešimus)), kaip nusižengimo subjekto, atsakomybės sąlygos ir ribos bei atvejai, kada deklarantas nelaikomas kaltu dėl muitų (muitinės) teisės aktų pažeidimų padarymo. Be to, straipsnyje pateikiami konkrečių praktinių situacijų, kuriose buvo pripažinta, jog, net ir netinkamai užpildžius muitinės deklaracijas, deklaranto administracinė atsakomybė nekyla, bei pristatomi teismų praktikos pokyčiai vertinant deklarantų kaltę ir griežtinantys reikalavimus muitinei, vertinančiai tokio pobūdžio veikas.

For the offenses committed, which are related to the implementation of customs brokerage activities, the customs broker bears responsibility established by the Customs Code of Ukraine (CCU) and … other laws of Ukraine. The person authorized to declare goods, commercial vehicles on behalf of the declarant has the same obligations, rights, and bears the same responsibility as the declarant. These norms are contradictory to each other. And on the basis of these norms of the Customs Code of Ukraine, the customs authority builds its further behavioural relationship with the customs broker.

It has now been established by the supreme judicial authority, that it is possible to amend the customs declaration subsequently, even with regard to the information relating to the identity … of the declarant. However, with some limitations, which we point out in the overview of the recent judgement of the European Court of Justice.

Kilo teisminis ginčas, kuriame išaiškinimus pateikė Europos Sąjungos Teisingumo Teismas (ESTT).
