Kas yra antidempingas?

Šalys gali taikyti antidempingo priemones produkto importui, jeigu jo eksporto kaina yra mažesnė nei „normalioji vertė“ (paprastai tai produkto kaina eksportuojančios šalies vidaus rinkoje), jeigu toks importas dempingo kaina daro žalą importuojančios šalies pramonei.

Kokiuose teisės aktuose nustatytas antidempingo priemonių taikymas?

Esmines nuostatas rasite Susitarime dėl Bendrojo susitarimo dėl muitų tarifų ir prekybos (GATT1947) VI straipsnio įgyvendinimo. Europos Sąjungoje yra priimtas Europos Parlamento ir Tarybos reglamentas (ES) 2016/1036 dėl apsaugos nuo importo dempingo kaina iš Europos Sąjungos narėmis nesančių valstybių.

Kaip inicijuoti antidempingo muito įvedimą?

Tyrimas pradedamas gavus bet kurio fizinio arba juridinio asmens, veikiančio Sąjungos pramonės vardu, rašytinį skundą. Skundas gali būti pateiktas Komisijai arba valstybei narei, kuri jį perduoda Komisijai.

Kaip įvedami antidempingo muitai?

Antidempingo muitai įvedami reglamentais, skelbiamais Europos Sąjungos oficialiajame leidinyje (OL). Pavyzdžiui, 2022 m. birželio 15 d. Komisijos įgyvendinimo reglamentas (ES) 2022/926, kuriuo, pagal Europos Parlamento ir Tarybos reglamento (ES) 2016/1036 11 straipsnio 2 dalį atlikus priemonių galiojimo termino peržiūrą, importuojamiems Indijos kilmės kaliojo ketaus (dar vadinamo ketumi su rutuliniu grafitu) vamzdžiams ir vamzdeliams nustatomas galutinis antidempingo muitas.

Kiek laiko galioja įvestos antidempingo priemonės?

Antidempingo priemonė galioja tik tol ir tiek, kiek būtina neutralizuoti žalą darantį dempingą. Galutinė antidempingo priemonė nustoja galioti praėjus penkeriems metams nuo jos įvedimo, pavyzdžiui, žr. pranešimą apie tam tikrų antidempingo priemonių galiojimo pabaigą, paskelbtą OL C 369 (2022.09.27).

However, in case of inward processing in the EU, the question has been raised, whether the duty rate of the processed goods at the time of release for free circulation must be applied in certain cases even though the tariff classification, customs value, and origin of the imported goods are the basis for the duty calculation.
