The language of sustainable development legislation and the language of the legislation of origin are completely different; it is necessary to find a lingua franca for these areas to better understand … and implement the requirements. On the other hand, harmonisation of rules of origin at a global level is essential to address the challenges faced by importers - the need for harmonisation of these rules has never been greater. These and many other views were exchanged at the 20th Authors' Meeting. We invite you to read an overview.

The EU has concluded more than 40 free trade agreements (FTAs) with around 80 countries, which supposedly bring significant benefits for trade with partner countries. But is this really the case, … i.e. is the EU fully utilising these benefits? This article attempts to assess the application of EU FTAs by analysing the flow of goods in and out of the main trading partners. The author looks at how import and export volumes and geography depend on the existence of preferential agreements.

In 2022, the WCO Secretariat sent a questionnaire to the Organization’s Members to gather information on certification of origin processes and the digitalization of the certificate of origin … (CO). Eighty-four Customs administrations responded, and a Study on the Digitalization of the Certificate of Origin, containing an analysis of the information received, was published in December 2023.

The Study provides a comparative analysis of origin provisions in a region which has the most numerous and complex overlapping trade regimes of the entire African continent.

The World Customs Organization has published a comprehensive study on the digitalisation of the Certificate of Origin (CO). This article provides a short summary of the existing CO issues and … suggests some solutions that could help achieve the long-term digitalisation goals – such as the framework for trusted digital signatures currently used in the EU.

Teisinis aiškumas ir tikrumas yra tai, ko reikia atitiktį siekiančioms užtikrinti bendrovėms, kad jos galėtų sutelkti dėmesį į savo pagrindinę veiklą. Įstatymų leidėjai stengiasi pateisinti šį … lūkestį, pavyzdžiui, numatydami tokias galimybes kaip privalomosios informacijos (PI) sprendimai. Deja, kuo daugiau teisinių nuostatų, tuo mažiau aiškumo. Muitinės priimtus PI sprendimus gali panaikinti Europos Komisija (pvz., Harley-Davidson byla), arba ES Teisingumo Teismas (ESTT) ginče dėl PI sprendimo gali nuspręsti, kad Europos Komisija, priimdama deleguotuosius teisės aktus, viršijo savo įgaliojimus. Pastarasis atvejis kelia klausimą, kiek privalomos yra deleguotų reglamentų, pavyzdžiui, SMK deleguotojo akto, nuostatos - pateikiame trumpą neseniai priimto ESTT sprendimo dėl nelengvatinės kilmės taisyklių apžvalgą.

Praėjo daug metų, jei ne dešimtmečių, kai prekybos reguliavimas „išaugo“ tarifus. Šiandien stebime, kaip daugėja politikos priemonių (pvz. atsakingo verslo elgesio reikalavimai, aplinkosaugos, … socialiniai ir gero valdymo reikalavimai (ESG)), kuriomis siekiama spręsti įvairias žmonijos problemas, įskaitant, bet neapsiribojant, vaikų darbą, vergiją, priverstinį darbą ir anglies dioksido išmetimą. Šiuos klausimus būtina spręsti moraliniais ir ekonominiais sumetimais, tačiau dabartinis modelis, kuriuo reikalaujama visiško žaliavų atsekamumo ir nustatomi susiję apribojimai, sankcijos ir draudimai pasienyje, kelia daugybę iššūkių. Pavyzdžiui, net jei importuotojas ir turėtų svertų ar galimybių stebėti tiekimo grandinę iki pradinių žaliavų kilmės vietos, gautas paveikslas būtų tik momentinis vaizdas, galintis dinamiškai keistis per kelias dienas ar net valandas.

However, a more ‘inconvenient truth’ today is that a considerable volume of critical information still circulates in the form of non-standardized documents sent via email. Today, new developments in Artificial Intelligence are proving promising in enabling the data extraction of these unstructured documents and scans to finally fully break the paper chain.

Global trade based on preferential treatment offers benefits to its participants. The main one is a reduction in financial costs due to the application of reduced tariff rates when the goods … have a preferential origin. In other words, if a product originates in one country and is sold to another country with which there is a preferential trade agreement, the product may be subject to a reduced or even zero duty rate. However, the mere fact that the goods originate in a particular country is not enough to qualify for such benefits. The preferential origin of the goods must be proven, so that the customs authorities do not suspect any manipulation or fraud on the part of importers. Each specific preferential trade agreement sets out acceptable ways of proving the preferential origin of goods. A supplier's declaration is one of the means of proof. Let us find out what it is and when it can be used.
