Some goods which need to be brought into a country for certain specific reasons (an exhibition, commercial demonstration, humanitarian mission, etc.) are exempt from Customs duties under the express condition that they are re-exported within a specified timeframe. This is what is known as the temporary admission procedure. The Convention on Temporary Admission signed in Istanbul on 26 June 1990 provided a means of bringing together, and simplifying, various instruments governing temporary admission which were already in existence at that time. The most important tools covered by the Istanbul Convention are the ATA carnet (for goods) and the CPD carnet (for vehicles), which are standardized documents used by Customs services to check temporary admissions. Nevertheless, many problems have been encountered with the application of the Convention in the field, and with the use of the carnets in certain specific circumstances. The training is therefore focused on the very practical issue of the use of ATA and CPD carnets, with lessons dealing in detail with the documents themselves and how they are used in different situations.

Digitization of ATA Carnets: overview of the ICC pilot project

The ATA[1] Carnet is an international Customs document that permits duty-free and tax-free temporary admission of most goods for up to one year. It enables countries, businesses and border agencies to expedite the Customs process by utilizing unified, ready-to-use declaration forms and eliminating the lodging of a guarantee, bond or cash deposit in the country of temporary importation. At the end of 2020, the ATA Carnet procedure has been implemented in 78 countries and Customs territories. In each one of them, the Customs authority appoints a National Guaranteeing Association (NGA) which guarantees payment of import duties and taxes in cooperation with foreign NGAs around the world. Under the NGA’s umbrella, there can be multiple issuing associations (IAs) in each country to process Carnet applications. Processing fees apply as well as a surety bond which will be returned if the Carnet has been used correctly. The International Chamber of Commerce (ICC), the institutional representative of over 45 million companies worldwide, is responsible for administering the global guarantee chain affiliated with all NGAs.

The article reviews one of the recent Association Agreements with the third countries which were concluded by the EU, namely, EU – Ukraine Association Agreement (2017), and, in particular, presents the experience and practice of Ukraine while implementing its commitments to harmonize national customs legislation with the EU customs law. The article describes efforts of the Republic of Ukraine to modernize its national sources of customs law and presents the summary of legal acts adopted in Ukraine while implementing the Association Agreement with the EU. The information provided in the article describes the conditions faced by all businesses engaged in trade between Ukraine and the EU as well as importing goods from the EU to the Republic of Ukraine.
